    From 'Default Approval' to 'Local Rejection': UK Plans to Tighten High Street Store Access

    Opening an e-cigarette or betting shop on the high street in the UK used to be a matter of "meeting the conditions to open"; however, this default pathway may soon be closed. The UK government is preparing to tighten store opening regulations, giving more decision-making power to local councils.

    The new proposal is not a blanket ban, but it is sufficient to change the logic of opening stores. Local governments previously found it difficult to block applications solely based on neighborhood planning or store density; in the future, they will be able to review applications on a case-by-case basis, making it easier to reject those that are unsuitable for the area.

    E-cigarette shops will no longer be classified with regular stores

    Currently, e-cigarette shops are in the same planning category as general shops, cafes, and banks. When a store changes to selling e-cigarettes, it usually does not need to reapply for planning permission.

    The UK government plans to consult on establishing a separate planning category for e-cigarette shops. Once classified in this new category, each new shop will have to undergo individual review by the local council. If the council deems the location unsuitable or believes there is already an oversupply in the area, it can reject the application.

    The change in planning categories may seem technical, but it will effectively rewrite the negotiation order between businesses and local governments. In the past, operators only needed to prove that their store was for general retail use, usually without having to explain "why it should be here"; after the new regulations are implemented, operators will first need to persuade the local council that their location and business model meet neighborhood needs.

    The government is also preparing to tighten the definition of e-cigarette shops to prevent operators from registering their stores as convenience stores or general retail shops while primarily selling e-cigarettes. Future disputes over approvals are likely to focus on how to define the main business. Product placement, sales ratios, and store promotions may all influence judgments.

    This will increase uncertainty for businesses and landlords. Stores that could quickly change tenants in the past may now need to wait for planning approvals; local councils will also need to provide justification for each approval or rejection.

    The definition issue will not easily disappear. A store that sells snacks, drinks, and e-cigarettes will require more precise criteria to determine whether it is a convenience store or an e-cigarette shop. If the rules only consider the store's name, they can easily be circumvented; if they require scrutiny of the sales structure and actual operations, it will increase enforcement and evidence-gathering costs.

    Betting shops will no longer enjoy "presumption of approval"

    Changes in the betting industry stem from a different set of regulations. The UK government plans to abolish the "aim to permit" rule in the Gambling Act. The current rule requires local councils to allow new betting establishments to open as long as the application meets the licensing conditions.

    With the removal of this rule, local councils will have fewer restrictions on rejecting new betting shops and 24-hour slot machine venues. New adult gaming centers in England will also require planning permission.

    This does not mean that local councils can arbitrarily veto applications. Each decision still needs to be based on planning and licensing grounds and may face appeals from operators. The main change is that the law no longer requires local councils to adopt a "presumption of approval" stance first, allowing neighborhood conditions, store concentration, and local risks to carry greater weight.

    The tightening of policies is also set against a backdrop of public safety concerns. The UK National Crime Agency (NCA) estimates that at least £1 billion in criminal proceeds is laundered through high street shops each year, with related activities including counterfeit sales, tax evasion, illegal labor, and drug supply. In April 2025, the BBC participated in a raid with the NCA, targeting establishments including barbershops, mini-markets, and e-cigarette shops.

    This does not imply that all related businesses are involved in crime, but local governments have limited options for dealing with suspicious shops under the current system. The new proposal aims to bring the approval power forward rather than addressing issues after they arise.

    For residents, the perception of shops and crime risk is often intertwined: similar signage, sparse customer traffic, and frequent cash transactions can easily be seen as "problematic." Policymakers need to balance responding to these concerns while avoiding the stigmatization of the industry. Case-by-case approvals can provide tools but may also concentrate disputes in local hearings and appeal processes.

    Economic factors cannot be overlooked either. The UK government's analysis of data from the Gambling Commission shows that a B3 gaming machine can generate an average gross gaming yield of £35,000 per year. The high revenue per machine means that some shops can remain operational even with low customer traffic, increasing local concerns about the ongoing expansion of betting shops.

    These figures explain why betting shops cannot be judged solely based on typical retail customer traffic. A shop with limited foot traffic may still rely on a few high-revenue machines to sustain operations. If local councils want to assess a shop's impact on the neighborhood, they cannot only consider vacancy rates and rents but must also take into account the density of betting supply and its social costs.

    Businesses will worry that standards vary by region. The same business model may be approved in one area but rejected in another due to store density. As local autonomy increases, companies expanding across regions will face more regulatory differences, leading to higher application costs.

    The new regulations will not automatically restore prosperity to the high street, but they will change who has the authority to decide whether a shop can open. Businesses will face longer approval timelines, landlords may experience slower turnover of premises, and local councils will bear more discretionary responsibility. For the UK high street, the most direct change is that meeting basic conditions no longer guarantees that a shop can open for business.

    The ultimate effect will depend on how locals use this power. If reviews are too lenient, policies may struggle to change the clustering of shops; if reviews are too strict, it may become harder to find tenants for vacant premises. After the UK government devolves decision-making power to local councils, managing the high street will not become simpler; it will shift from a unified default rule to a series of specific location judgments.
